Besides not working well in a linear story game like Diablo, the whole, "I get to choose whether I'm good or evil" is still a very difficult mechanic to implement.
In a game like Oblivion where things are more open ended, you can have good and evil ELEMENTS to your character, but even then it's just not feasible to be really evil. You can kill a townsperson... if you don't ever want to shop in that town again.
Same thing in Fable. There were no "evil" towns, so if you built your character on the darkside, you simply couldn't go anywhere or buy anything. Sure you got to choose sides, but one side really sucked and had no resources.
If they had some sort of "Shade of Grey" system I wouldn't be opposed to it... have choices in the game, like using your mercenaries as bait to draw out something or not helping some random NPC or finding the Horadric Malus and using it instead of giving it to Charsi. Eventually, these things result in higher prices in town, less things to purchase, maybe even different side quests (or lack thereof), and in return you get the intangible benefit of your choice (merc dies instead of you, you keep the malus, etc).
Don't think this is in the plans though, and honestly, since I don't see a fool proof way to implement it, I'm kind of glad.
