I, too like the idea of rares being better than uniques. However, maybe they need to add another tier. Three levels of randomly generated gear, not just two.

Also, maybe make skills and especially skills scale better w/ gear, especially multiple stats; more types of characters can benefit from more types of gear (this would also hopefully avoid classes being artificially denied weapons or armor types). Consolidate similar stats, like attack rate and spell cast rate.

Re: Rares resume their place as the most powerful items in game!

When deciding on item catagories I would want Blizzard to consider situations that people would want an item from as many item classes as possible. Having some atributes on Magic items that do not apear on Rare items is one example of a limited situation people would want to pick up and check a magic item.

I really like the huge swing in item quality that can be found on a Rare item. That is part of the excitement and fun. If you divide rares into "good rares" and "crappy rares" you just create an item class that everyone ignores.

Re: Rares resume their place as the most powerful items in game!

Unique items are probably the least unique things you could wear in D2. Rares are unique... why don't they just change the names around, and make it possible for rares to have better mods, but a bigger pool of mods so the chances of a good rare are hard to come by?

Another idea is for rares to be upgradable with 1 modifier that is normally available on uniques. Maybe you could get some blacksmith guy to rip a mod off of your unique item (destroying it) and then put that mod on a rare weapon of the exact same type. And you could only do this once (with certain mods like ED being disallowed).
