    9/11 conspirator's court case to go forward without key evidence

    But after a day-long hearing, she decided to continue the trial that will determine if Moussaoui, who has pleaded guilty to conspiracy in connection with the hijacked airliner attacks, will be executed.

    Judge Brinkema, however, said the Federal Aviation Administration and Transportation Security Administration witnesses who had been contacted by government lawyer Carla Martin would not testify and evidence from them would not be allowed.

    The prosecution had argued the witnesses were key.

    In a stinging rebuke to prosecutors, the judge said: "I don't think in the annals of criminal law there has ever been a case with as many significant problems."

    She struck out evidence relating to aviation, including the question of whether lies by Moussaoui prevented the introduction of new security measures which could have prevented the September 11, 2001, attacks.

    "I am removing from the case any and all witnesses having to do with the aviation component of this case," she said.

    If by court case you mean sentencing, then yes it is proceeding without at least one part of the prosecution's evidence.

    He's pled guilty they are just figuring out what evidence is inadmissable at the sentencing hearing.

    Ah, thanks for that. Yes, as I suspected my news provider garbled the story a bit.

    That's a hell of an indictment. The real question is, given the magnitude of this case why on earth is the prosecution being so ridiculously slipshod? I mean, exposing a witness to trial testimony? Even I know that's going to get that component of your case thrown out of court.

    It's a governement run prosecution, expect it to cost too much and screw up the basics.

    Or, if you prefer, it is all part of a massive, competent conspiracy to make sure he doesn't get Death (since he never killed anyone) and use him as a secret cybernetic Al-Quaeda operative. You know, the $6 Million Dollar Mole or something.

    Maybe he's the last piece to complete the sleeper cell Alqaida has been assembling in US jails. I guess that one was begun before they had a mastermind....
