If by court case you mean sentencing, then yes it is proceeding without at least one part of the prosecution's evidence.
He's pled guilty they are just figuring out what evidence is inadmissable at the sentencing hearing.

That's a hell of an indictment. The real question is, given the magnitude of this case why on earth is the prosecution being so ridiculously slipshod? I mean, exposing a witness to trial testimony?
