What I watch in my leisure time
What do you think just punishment should be? Should she be convicted of felony murder?
Based on her actions, it's probable she could or will plead insanity
and a just general...WHAT THE HELL WERE YOU THINKIN, LADY?
All I can think is that she's an adult, she knows better than to let a man bleed to death without helping out. Her actions are those of a murderess and she should pay the full price for her bad choice.
im surprised that they didnt throw the book at her -- i guess texas citizens will be pleased to know that they can kill the homeless and receive a lighter sentence
Let's see: vehicular manslaughter which became murder, negligence, abuse of a corpse, DUI. Yep, another stellar human being. I don't care WHAT your background is ("Little Johnny got all A's in grade school!" "Ma'am, what matters is that he killed 100 people with a toothpick!"), that is no excuse for murder. Her lack of remorse and her apparent glee at "killing a white man" makes her crime all the more heinous.
In my opinion, I'd give her 25-to-life with the possibility of parole no sooner than 25 years into her sentence and even that would be conditional on her completing a DUI program and psychological counselling. Killing her won't bring the guy back and watching someone rot in prison is more just anyway (a life for a life seems fair but as her life appears to be worth less than her victim by her actions, how can that be fair?...taking away the freedom she failed to grant her victim is much more just).
murder and tampering with evidence.
Vehicular Manslaughter cannot become murder. The manslaughter parts implies death has already taken place, and you cant murder a dead person. If you wanted to kill someone with your vehicle, then it would never be manslaughter in the first place, it would be murder from the start.Originally Posted by Necrolestes
Ive done some researching, and I cant find any law definition of murder that doesnt include "intent to kill". Whether its 1st, 2nd, or 3rd, they all have intent to kill embeded in them.
This lady, as stupid as she is/was, had no intent to kill. You cant be charged with murder for 'letting someone die' but you can be charged with their death in another form. Manslaughter seems the most appropriate in this case.
Thanks for the clarification, Toader. I suppose I could term it "vehicular manslaughter with gross bodily harm" instead. Nonetheless, it is still a heinous crime.
When she made the choice to let him remain there. Thats murder.
Also the fact that instead of driving off to the side of the road where someone could see the wounded man and call for an ambulance she drove the injured person into a garage and closed the door so no one could see or alert paramedics and so the wounded person died after several hours of no medical attention.
She could save his life by doing nothing at all but instead she put effort into making sure his life would not be saved.
No, it isnt. Letting someone die will get you in trouble, but it is not murder.Originally Posted by Johnny
That doesnt make what she did even close to right, but I am just laying down the facts. Hopefully they will find enough things to charge her with to put her away for a long time.
