Is there a difference between hiring my merc at say level 40 and leveling him up manually and hiring a merc when I hit level 80 and letting the vender increase his level?

No. The only difference would depend on what act you hire the merc- NM act 2 mercs have different auras, and generally mercs hired in latter acts are weaker.
