I suggest to install the latest drivers of your gfx card. If you are already using the lastest version, reinstall it. You should uninstall the current version before, in case parts of it are corrupt and they are not replaced or removed be the update.
But be warned: Exchanging drivers might lead to complications, so if you are unsure about what to do, get help from an expert who is present at your computer. Don't blame me if it gets worse :wink3:

Did you run the video test ? If yes, did it suggest using Direct 3D and test passed ?
Also, the game is really not 3D at all, so why not just choose 2D instead ?

A friend of mine is having the same issue with her recently purchased Diablo 2 game. I had her run the Vid Test, and then switch to the 2d, it gave the same error.
sounds like you might have driver problems
as Khrischan said, download the latest drivers for your video card
then run dxdiag and do the d3d and ddraw tests on the video page
d3d has better lighting effects and supports the perspective viewpoint, looks a little 3d

Have you tried running it in windowed mode? I have a older pc that was giving the directx errors but after i set it in windowed mode it's fine. it's how the os handles d3d and direct draws when it's in fullscreen mode that's mostlikely causing the problems.
I just had this problem in Windows Vista 64. I'm running 3 monitors with an NVIDIA 260 for the first and second and an IOGEAR external USB for the third.
Fix was to open 'Display Settings' under 'Personalization' ('Personalize'?! if you right click on desktop) and check the box for one of the NVIDIA 260 monitors as 'This is my main monitor'. Diablo 2 started right up after that.
I'm assuming that if you're running multi-monitors in Windows Vista and get this error that everything else is working and all drivers and directX are up to date.
Hope this helps. - SmR
