me and a friend are about to do ubers. i have a torch in my inv, and he does not.... will one still drop? i remember hearing something about if you have a unique in inv, the same type will not drop in game.

As long as you kill them, a Torch will drop. It doesn't matter whether you already have a Torch or not. A single Torch will still drop upon the Ubers' death.

The torch will drop but only your friend will be able to pick it up. It is one torch max in one characters inventory - same as with other unique charms.

Not only inventory, but also stash/cube etc.

Lets put it this way:

-A character can only possess one torch at a time.
-A torch will always drop, no matter what.
